Amendment Order for the Ortho Phosphoric Acid

OVERVIEW

The Ministry of Chemicals and Fertilizers has issued the second amendment to the Ortho Phosphoric Acid (Quality Control) Order, 2021. This amendment, known as the Ortho Phosphoric Acid (Quality Control) Order, 2021 second Amendment Order, 2024, will come into force on July 26, 2024. The key provisions are as follows:

1. Amendment Insertion:

• In the Ortho Phosphoric Acid (Quality Control) Order, 2021, a new proviso is added after the existing table:

• "Provided that nothing in this Order shall apply to Ortho Phosphoric Acid when used as a raw material in the production of fertilizers."

2. Scope and Applicability:

• This Order applies to goods or articles of Ortho Phosphoric Acid but does not apply to such goods or articles meant for export.

• Goods or articles of Ortho Phosphoric Acid must conform to Indian Standard IS 798:2020 and bear the Standard Mark under a license from the Bureau of Indian Standards as per Scheme-II of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.

3. Certification and Enforcement:

• The Bureau of Indian Standards (BIS) shall be the certifying and enforcing authority for Ortho Phosphoric Acid goods or articles.

4. Penalties:

• Any person who contravenes the provisions of this Order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016. This amendment aims to ensure that Ortho Phosphoric Acid used in fertilizer production is exempt from the quality control order while maintaining strict standards for other uses.
