BIS Quality Control Order for the Cement

Dear Reader,

Important update regarding Indian Standard applicable to all existing Licence holders/ New applicants/ manufacturers/ importers/ product sellers for the Cement Quality Control Order, 2003.

This Order may be called the Cement (Quality Control) Order, 2003.

It shall come into force on 17th February 2003.

OVERVIEW

Definitions:

  • "Act" means the Bureau of Indian Standards Act, 1986 (63 of 1986).
  • "Appropriate Authority" means an officer not below the rank of an Under Secretary to the Government of India or an officer not below the rank of a General Manager, District Industries Centre of a State Government, as appointed by the Central Government or the State Government through a notification in the Official Gazette.
  • "Bureau" means the Bureau of Indian Standards.
  • "Cement" includes any variety of cement manufactured or sold in India, such as IS 12330: Sulphate Resisting Portland Cement, IS 12600: Low Heat Portland Cement, IS 1489 (Part 1): Portland Pozzolana Cement - Part 1 Fly-ash based, IS 1489 (Part 2): Portland Pozzolana Cement - Part 2 Calcined clay based, IS 269: Ordinary Portland Cement, IS 3466: Masonry Cement, IS 455: Portland Slag Cement, IS 6452: High Alumina Cement for Structural use, IS 6909: Super Sulphated Cement, IS 8041: Rapid Hardening Portland Cement, IS 8042: White Portland Cement, IS 8043: Hydrophobic Portland Cement, IS 8229: Oil Well Cement, IS 16415: 2015: Composite Cement – Specification, IS 16993: 2018: Microfine Ordinary Portland Cement – Specification, IS 15895: 2018: High Alumina Refractory Cement or any other variety specified by the Central Government.
  • "Dealer" refers to a person, firm, or Hindu Undivided Family engaged in buying, selling, supplying, or distributing cement.
  • "Manufacturer" refers to a person, firm, or Hindu Undivided Family producing, making, or manufacturing cement, including those claiming such production.
  • "Specified Standard" means the Indian Standard Specification for cement prescribed by the Bureau of Indian Standards.
  • "State Government" includes a Union Territory Administration.
  • All other words and expressions not defined in this Order shall have the meanings assigned to them in the Act.

Prohibition on Non-Standard Cement:

  • No person shall manufacture, store for sale, sell, or distribute cement that does not conform to the Specified
  • The Central Government may permit the manufacture or sale of cement without the Standard Mark for up to 150 days if the grant of the Standard Mark is pending.
  • Exemption from the Standard Mark may be granted for cement manufactured for export purposes, adhering to overseas standards or buyer's specifications.
  • Cement that does not conform to the Specified Standard must be destroyed within a month.

Obligation for Certification:

  • Manufacturers must apply to the Bureau for a licence to use the Standard Mark within 45 days of this Order, if not already obtained.
  • The grant of a licence will be as per the provisions of the Act and related rules and regulations.
  • Any person proposing to manufacture cement must apply to the Bureau before commencing production.
  • The Bureau must inform the Appropriate Authority immediately about the expiry, cancellation, or rejection of any licence.

Power to Call for Information:

  • The Appropriate Authority may require any person involved in the manufacture, storage for sale, sale, or distribution of cement to provide necessary information and furnish samples.
  • The Appropriate Authority can inspect books, documents, or cement in possession or control of any person engaged in these activities.
  • The Authority may enter and search premises and seize cement suspected of not meeting the prescribed standards, applying the provisions of the Code of Criminal Procedure, 1973 (2 of 1974).

Testing of Samples:

  • Samples of cement bearing the Standard Mark, drawn by the Appropriate Authority, shall be tested in a Bureau-approved laboratory to ascertain compliance with the Specified Standard.

Compliance with Directions:

  • Any person engaged in the manufacture, storage for sale, sale, or distribution of cement must comply with directions issued under this Order.

Obligation to Furnish Information:

  • No manufacturer or dealer shall, with intent to evade the provisions of this Order, refuse to provide any lawfully demanded information or conceal, destroy, mutilate, or deface any books, documents, or cement in their possession or control.
