Market Surveillance of Products under Electronics and Information Technology Goods (Compulsory Registration) Order, 2021

The Ministry of Electronics & Information Technology (MeitY) has officially announced the "Electronics and Information Technology Goods (Requirement of Compulsory Registration) Order, 2021." This order is enacted under the authority granted by sub-sections (1) and (2) of section 16, along with sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016.

Role of Software Technology Parks of India (STPI)

The Software Technology Parks of India (STPI) has been assigned the responsibility of assisting the Ministry in carrying out surveillance activities as stipulated by the Order. The surveillance ensures compliance with the standards set forth by the Bureau of Indian Standards (BIS).

Surveillance Cost and Sample Selection

The costs associated with surveillance will be borne by the respective manufacturers or licensees. The surveillance process involves selecting samples randomly from the open market. These samples will be procured and submitted to BIS-recognized laboratories for testing, managed by STPI.

Execution of Surveillance

Detailed instructions for executing surveillance will be provided to registered manufacturers and their authorized representatives. These instructions will also be communicated to the designated BIS-recognized test laboratories at the time of issuing Surveillance Orders. The orders will be applicable to selected Registration Numbers of the licensees/manufacturers/labs.

Cooperation from Registered Manufacturers

Registered manufacturers are requested to fully cooperate with the surveillance activities. This includes updating contact details, providing necessary information and documents promptly, and making timely payments as demanded. Cooperation is essential to ensure the surveillance process is completed in a timely manner, thus avoiding any penal actions as prescribed under the BIS Act, 2016. This notice is issued with the approval of the Competent Authority.
