Draft Notification Issued: Plastic Waste Management (Second Amendment) Rules, 2025

The Ministry of Environment, Forest and Climate Change (MoEF&CC) has issued a Draft Notification dated 3rd June 2025, proposing key amendments to the Plastic Waste Management Rules, 2016. These changes aim to strengthen the enforcement of Extended Producer Responsibility (EPR) and ensure sustainable plastic packaging practices in India.

Key Highlights of the Draft Amendment:

1. Mandatory Use of Recycled Plastic in Packaging

Producers, importers, and brand owners must now ensure the inclusion of recycled plastic in packaging materials under the following categories and timelines:

Category 2025-26 2026-27 2027-28 2028-29 & onwards
Category I (Rigid) 30% 40% 50% 60%
Category II 10% 10% 20% 20%
Category III 5% 5% 10% 10%

Note: Exemptions may be granted on a case-by-case basis for statutory or technical limitations.

2. Use in Food Contact Applications

For plastic packaging used in food-related applications, any shortfall in recycled plastic usage in 2025-26 may be carried forward for up to three years from 2026-27 onwards, over and above future targets.

3. Importers' Responsibility

Importers must comply with recycled plastic obligations similar to producers. Notably:

  • Recycled content already present in imported plastic will not count toward compliance.
  • Obligations must be met via purchase of certificates from entities exceeding their targets.
  • A centralized online portal will be developed for trading certificates and reporting.

4. Rigid Plastic Packaging Reuse Targets for Brand Owners

Brand owners using rigid (Category I) plastic must meet minimum reuse obligations:

Shortfalls in reuse targets for 2025-26 can also be carried forward over the next three years.
